So what is a public record? In the strictest sense, ‘public records’ refers to those records held by governments that are accessible to the public. Court records, property tax records, deeds and other recorded documents, vital statistics, and business license records are some of the more common types of public records. For the most part, one can not have this type of public record modified or removed.

Exceptions include the expunging of a court record. This may seem unfair when a person is trying to get a youthful indiscretion off their record, but this is mainly done for the safety of the public. If removing an arrest record was an easy task, many murderers or rapists could easily clear their record and we would have no information on their past. Even if there was a record of a terrible crime, it is the criminal’s responsibility to prove the record as inaccurate. Each state has their own records and jurisdictions.

If a crime was committed in multiple states, there could be multiple states with information of that individual. Some states or local governments provide direct information on their own web sites, while others provide links to other resources, the ease of access of which varies tremendously.

States continue to provide more information online and the legislatures and general public continue to demand this type of access to what are, after all, public records. We as citizens have a right to this information and a right to use this information to protect ourselves and our businesses. This type of information can be quite valuable to a person who is a landlord or someone who is choosing a nanny for their child. This information is for the protection of us all equally. Public records are exactly what they are called, for the public.
