The wheels on the bus go round and round, round and round, all through the town. But who is putting their foot on the pedal to propel the bus through the town? Teachers are the ones who mold children’s minds, educating them and giving them the principals and skills to make it in the world. Teachers should be praised and commended for this but one person who flies under the radar is the bus driver. They drive your children to and from school. They are responsible for the well being and safety of your child once they set foot on that bus. There are plenty of good bus drivers out there but what about the bad ones?
Steve, a bus driver from northern Iowa had an addiction to pain killers and was in and out of rehab numerous times. He even did months of jail time because he was caught stealing in order to get money to pay for his next fix. This was all found out after he drove a bus full of kids into a ditch. He was fired the next day. John, a bus driver in Montana was a convicted sex offender. His records showed he was on the sex offenders list but this was only found out after complaints from certain children who rode his bus. He was fired the next day.
Then there was Patty from New York. She was an alcoholic with a D.U.I on her record. She came to work with booze on her breath, ran a red light, and caused a wreck involving two other cars. She was fired the next day. No children in any of these cases were seriously hurt but they all have the same thing in common. It wasn’t until the driver messed up that a background check was done. Wait! Before you say ‘I do’ maybe you should ask ‘What’s true?’ A recent bride in Oklahoma learned the hard way. She met her man on the Internet. The she spent two years getting to know him. But what did she know? Her man had bought her flowers every week, was attentive, faithful, and everything she had hoped for. He attended church with her every week and became a volunteer Sunday School teacher and youth group leader. His charms won everyone over. Her friends and family all liked him. Time and time again employers have been held responsible for the negligent or criminal acts of their employees. Hiring is tough these days. Hire the wrong person and you will not just have to fire them, but you could possibly face lawsuits from other employees, clients, prospects, vendors, the public, customers, and other companies. Thomas and Mary Hines hired a contractor Metropolitan Painting Associates to paint and remodel their home. Metropolitan sent an employee Allen C. to paint the Hineses’ home. Metropolitan was aware that Cain had a chemical dependency problem and had been convicted for three felonies. The Hineses discovered that Cain stole some checks from their home. Thus, the employer terminated Cain. However, after his termination, Cain returned with some friend to burglarize the Hineses’ home. The Hineses were at home during the burglary, and Cain and his friends assaulted and robbed them.
The Hineses sued the employer for negligent hiring. The trial court awarded damages in favor of the Hineses and against the employer. Employers could be found liable for negligence for employee criminal activity and employee negligence, for not conducting background checks. Just one lawsuit can damage a company financially, morally, and publicly.
Negligent hiring claims are a fast-growing area of employment litigation. Employers have been found liable for many employee acts committed in the scope of employment. This is true of violent crimes, intoxication, assault, manslaughter, sexual harassment. embezzling client funds, and many more. How can employers protect themselves? It starts in the hiring process. • A prosecutor asked for federal prison time for a lawyer who bilked his elderly clients of millions of dollars. He abused their trust by misappropriating $1.7 million of his elderly clients’ money. Denise and William of New York hired a 20-year-old Swiss au pair to care for Kristie, then a 2-month-old baby. Then, Kristie died in a house fire. The au pair faces charges of murder and arson for allegedly dousing the bedrooms with paint thinner and setting the fatal blaze. Working parents seeking Nannies are worried. Todd and Lisa of Wisconsin have had seven different nannies in the past three years. Two were fine, two left without notice, one ran up a huge phone bill, and another had a boyfriend who called collect at all hours, and another got a DUI with their daughter in the car.
